Terms of Service

Acceptance

These Terms of Service (“Terms”) govern access to the XPLIGHT mobile application (“App”) published by XPLIGHT. By downloading, installing, or continuing to use the App, you agree to these Terms. If you cannot agree, do not use the App.

Eligibility

You must be able to form a binding contract in your jurisdiction and meet any minimum age required by Google Play or local law. If you permit a minor to use your device, you are responsible for their activity.

License grant

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to run the object code of the App on devices you own or control. You may not rent, lease, sell, sublicense, or host the App for third parties.

Description of the experience

XPLIGHT offers lightweight tap-based gameplay, visual progression, and optional variations in pacing or objectives. Features, artwork, balancing, and availability may change with updates. We may retire content or introduce new mechanics without prior notice.

Virtual items and purchases

Some builds may include consumables, cosmetic boosts, or other digital goods billed through Google Play. All sales are final except where mandatory consumer laws provide otherwise. Virtual items have no real-world cash value and may be altered or discontinued.

Acceptable use

You agree not to cheat, exploit bugs for unfair advantage in competitive contexts, harass others through any future social feature, scrape our servers, reverse engineer except where statute permits, or use the App in violation of export or sanctions rules.

Intellectual property

The App, including its name, logos, art, audio, and code, is owned by XPLIGHT or its licensors. No rights are granted except the limited license above. Feedback you voluntarily provide may be used without obligation to compensate you.

Third-party services

The App may link to or embed services operated by Google, analytics vendors, or ad networks. Their terms and privacy notices apply in addition to ours.

Disclaimer of warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

Limitation of liability

TO THE EXTENT NOT PROHIBITED BY LAW, XPLIGHT AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY ARISING OUT OF THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS.

Indemnity

You will defend and indemnify XPLIGHT against claims arising from your misuse of the App or violation of these Terms, except to the extent caused by our willful misconduct.

Suspension and termination

We may suspend or terminate access if we reasonably believe you breached these Terms or pose a security risk. You may stop using the App at any time. Provisions that by nature should survive (limitations, indemnity, governing law) will remain in effect.

Governing law and disputes

Unless mandatory local law requires otherwise, these Terms are governed by the laws of the jurisdiction identified in your store listing contact details, without regard to conflict-of-law rules. Courts in that jurisdiction have exclusive venue, subject to any non-waivable rights you may have as a consumer.

Changes to the Terms

We may revise these Terms when we ship meaningful updates. The new effective date will be posted here. Continued use after changes constitutes acceptance unless applicable law requires a different process.
